BOOKING FORM Terms & Conditions TERMS & CONDITIONS This contract is designed to protect the Client and the Photographer. Its purpose is to set out in writing exactly what you as the Client can expect to receive and what I as a Photographer must provide. It is not always possible to remember exactly what has been agreed at each meeting, which is why this contract shall take precedence over any verbal agreement. Should we have agreed anything outside of this contract, please add it to the notes section. On receipt of this contract, I will indicate my acceptance of these notes via email and that they shall form part of the contract. It is therefore your responsibility to ensure anything agreed between us, not included in the contract is included in the notes section. It is mutually agreed that the following terms of the contract form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both parties in writing. This contract for wedding photography is effective and binding from the date it is agreed by both parties and the deposit having entered the Photographer's account. 1. The Services and Products The Photographer agrees to be in attendance on the wedding date and to take photographs during the agreed period. The Photographer agrees that the Client will be provided with the photography package selected by the Client as described on the invoice. Where the products necessary to produce, the selected package are no longer manufactured or available from the Photographer’s supplier, a product of similar specification may have to be substituted of at least equal quality and any difference in price shall be borne by the Photographer. 2. The Coverage The Photographer’s coverage is limited by the guidelines of the ceremony official or the venue site management. The Client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of the guidelines is the Clients responsibility. The Photographer will offer technical recommendations only. 3. Payment Arrangements The Client will pay the Photographer the total fee indicated on the invoice (herein referred to as the ‘Total Fee’) subject to the following terms: The agreed deposit, as indicated on the invoice to secure the date (herein referred to as the ‘Deposit’) is payable on execution of this contract. This deposit is non-refundable or transferable in any circumstance. Payment of the balance, as indicated on the invoice (herein referred to as the ‘Balance’) is to be made on the 1st day of the month before the date of the wedding. Any additional payments for albums and other services can be made when pleased. Prices for orders placed over one year after the date of the wedding may be subject to change from the last price effective as at the date of the wedding. This includes orders that are part of the initial wedding package e.g. the bride and groom’s album. After 1 year the Photographer can not guarantee that the images will still be available. 4. Cancellation If the Client cancels this contract within 4 weeks of the date of the wedding, the Photographer will require the Total Fee. If the Client cancels this contract more than 4 weeks before the date of the wedding the Photographer is only entitled to keep the Deposit. All cancellations must be in writing. The cancellation conditions above will apply for postponed weddings if the Photographer is not able to re-schedule for the new date and time. In case of a postponed wedding a fee may be applicable. In the unlikely event that the Photographer is unable to complete the coverage due to unforeseen circumstances including but not limited to illness or injury, the Photographer reserves the right to appoint another photographer to attend on his behalf to undertake the photography. If this is not possible the Photographer’s liability shall be limited to a refund of the Balance paid by the Client. 5. Force Majeure The performance of this contract is subject to the Photographer’s ability to work and performance of the Photographer’s services shall be excused due to circumstances beyond the Photographer’s control, including without limitation, catastrophic mechanical failure, images lost in the mail, electronically or otherwise lost or damaged without fault on the part of the Photographer, acts of God, epidemics, explosion, fire, flood, national emergency, acts of terrorism or any other legitimate condition beyond the Photographer’s control. In the unlikely event, that the Photographer is prevented from fulfilling his obligation under the contract, then the Photographer’s liability shall be limited to a refund of the Balance paid by the Client. 6. Copyright The Photographer retains the entire copyright of the photographs at all times. Where photographs are provided to the bride and groom as part of their weddi ng collection, these photographs may be printed, and displayed online, for personal use. The client may use the photographs for commercial use only if prior agreement has been granted by the Photographer. The Photographer retains the right in all cases to use the photographs in any manner at any time for the purposes of advertising or otherwise promoting his work. 7. Image Size, Colour, Style and Composition All image sizes are approximate. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes not possible to print the exact colour as seen by the human eye. There is no right to reject on the basis of style or composition. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs. The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation. 8. Limitation of Liability The Photographer agrees that every effort will be made to provide high quality photographic services. In the unlikely event that the Photographer is unable to provide the Client with the agreed upon photography services and/or products the Photographer and the Client agree that the Photographer's liability under this Agreement shall be limited to a refund of the Balance paid by the Client. The Photographer will not be liable for any other direct or indirect loss or damage, emotional or otherwise. 9. The Booking Details The Client agrees that they are responsible for providing all of the correct details regarding the date, time and each address the Photographer should attend. They also agree they have responsibility to check that all building names, street, road and postcode details match. If the Photographer arrives at a postcode, building, street or road given by the Client, the Photographer will be deemed to have arrived at the correct address. Should the correct postcode be disputed, the correct postcode will be as defined by the Royal Mail.
